This document concerns personal data processing arising out of using the Website, i.e. services available via website https://sklep.motiveandmore.pl/, in particular services regarding running accounts (of both users and sellers) at this website and sending newsletters. Terms and conditions of providing services at the website are available at sklep.motiveandmore.pl.
This document shall also apply to personal data provided during participation in our contests or promotional campaigns, even if the data wasn’t provided via our Website.

II. Purpose and basis for processing
MM processes personal data of the Website Users for the purposes of:
proper performance of the agreements concluded within the framework of on-line store via website: www.sklep.motiveandmore.pl (hereinafter “Website”) (Art. 6 section 1 b of GDPR), which means that the data is in particular necessary to:
- register in the Website
- conclude an agreement
- perform settlements
- deliver goods ordered by the User
- exercise all consumer rights by the User (e.g. withdrawal from the agreement, warranty).
for archiving (evidential) purposes in order to secure the information in case there is a legal need to prove facts, which is a legitimate interest of MM (basis of art. 6 section 1 letter f of the GDPR);
for the purposes of possible determination, investigation or defense against the claims, which is a legitimate interest of MM (basis of art. 6 section 1 letter f of GDPR);
for the purpose of conducting client satisfaction survey and determining the service quality, which constitutes legitimate interest of MM (basis of art. 6 section 1 letter f of GDPR);
for the purposes of offering you MM products and services directly (direct marketing), including choosing them according to your needs with the use of profiling (explained herein), which is a legitimate interest of MM (basis of art. 6 section 1 letter f of GDPR);
for the purposes of offering you products and services of the companies cooperating with MM (our partners) directly (direct marketing), including choosing them according to your needs with the use of profiling (explained herein), which is a legitimate interest of MM and our partners (basis of art. 6 section 1 letter f of GDPR);
After granting consent to receiving information about new products and discounts, MM shall process your data for the purposes of sending you commercial information regarding promotion or sales which is included in the newsletter.
III. Type of data
MM processes the following personal data which is necessary to purchase goods at the Website:
- full name
- delivery address
- telephone number
- e-mail address
- NIP (in case of the companies)
In the event of withdrawal from the agreement or accepting a complaint, please provide a bank account number for the refund if it is supposed to be sent directly to the User's bank account.
IV. Data recipients
Your personal data may be disclosed to the following categories of entities: subcontractors, i.e. entities used during data processing: accounting companies, IT companies, hosting companies, analytical and marketing agencies, providers of payment and transport services (courier and InPost Paczkomaty Sp. z o.o. with its registered office in Kraków, providing delivery and parcel locker services) and other independent recipients: commercial partners whose offer complements ours and entities handling the newsletter.
V. Transferring data to third countries or international organizations
We do not transfer your data outside of the area of Poland/EU/European Economic Area.
VI. Duration of data storage
Your personal data shall be stored until User deletes the Website account. Your account can be deleted upon your request or if you withdraw the consent for your data processing, object to your data processing or request us to delete your data.
MM's systems shall only retain archival information about your transactions whose storage shall be related to claims, e.g. under the warranty, as well as with respect to legal regulations applicable to MM.
Your primary contact data stored for the direct marketing purposes of our products and services shall be stored until you withdraw the consent for your data processing, object to your data processing, request us to delete your data or when MM establishes that the personal data is no longer valid.
VII. Your rights:
You shall have the right to:
a) access your data and receive the data copy
b) rectify (correct) your data
c) erase your personal data
If you think that we have no basis for processing your personal data, you have the right to request us to delete it.
d) limit data processing
You have the right to request us to limit your personal data processing solely to data storage or performance of activities agreed upon with you, if in your opinion we may have your incorrect data or process it unjustifiably; or if you do not wish us to delete it because you need it to establish, assert or defend your claims; or for the duration of your objection to data processing.
e) object to data processing
“Marketing” objection. You have the right to object to your personal data processing for the purposes of direct marketing. If you exercise this right - we shall stop data processing for this purpose.
f) transfer data
You have the right to receive data provided by you on the basis of the agreement or your consent in a structured, commonly used machine-readable form (e.g. “.csv” form). You also have the right to request us to transfer this data directly to another entity.
g) lodge a complaint with a supervisory authority
If you decide that we are processing your data in an unlawful manner, you have the right to lodge a complaint with the President of the Data Protection Authority or other competent supervisory authority.
h) right to withdraw your consent to personal data processing
You have the right to withdraw your consent to personal data processing which is processed on the basis of your consent at any time. Withdrawing the consent shall not affect the legality of prior processing.

Profiling means personal data processing which involves using your personal data to evaluate some of your personal qualities, in particular to analyze or forecast aspects regarding your work performance, economic situation, health, personal preferences, interests, reliability, behaviour, location or movement.
Purpose of automated decision making (profiling) is to improve and facilitate providing services on the Website for the purposes of personalized newsletter and marketing (including analyzing and profiling data for marketing purposes) of MM products and services.
Profiling shall be continued to the point of your effectively raised objection.
