I. Definitions

Terms used in the Regulations shall mean:

  1. Client - natural person, legal person or organizational unit other than legal person, to whom special provisions grant legal capacity and who places Orders within the Store.

  2. Civil Code – Act of 23 April 1964 (Polish Journal of Laws Dz. U. no. 16, item 93 as amended);

  3. Regulations - these Regulations;

  4. Online Store (Store) – website available at, where the Client can in particular place Orders;

  5. Goods – products presented in the Online Store;

  6. Sales Agreement – agreement on sales of the Goods within the meaning of the Civil Code, concluded by and between Motive&More Sp. z o.o. and the Client, concluded with the use of Store website;

  7. Consumer Rights Act – Act of 30 May 2014 on consumer rights (Dz.U. of 2014 item 827);

  8. Act on Providing Services by Electronic Means – Act of 18 July 2002 on providing services by electronic means (Journal of Laws 144, item 1204, as amended);

  9. Order – declaration of Client’s will which directly leads to concluding Sales Agreement defining in particular the type and quantity of Goods.


II. General provisions

2.1. These Regulations shall define general terms, rules and method of sales conducted by Motive and More sp. z o.o. with its registered office in Kraków by an Online Store and shall define terms and conditions of providing services free of charge by electronic means by Motive and More Sp. z o.o. with its registered office in Kraków, including, but not limited to: 

  1. types and scope of services provided by the Seller, 

  2. terms of providing services by the Seller, including: 
    a) technical requirements necessary for cooperation with ICT system used by the Seller,
    b) prohibition of providing unlawful content by the Client; 

  3. terms of concluding and terminating agreements,

  4. complaint handling procedure. 

2.2. Using online store is possible only if ICT system used by the Client meets the following minimum of technical requirements.

2.3. Client shall be responsible for ensuring a computer station or end device with an Internet access in order to use the online store.

2.4. According to applicable provisions of law, Motive&More Sp. z o.o. has the right to limit providing services of the Online Stores to only people aged 18 years and older. In such case, prospective Clients shall be notified about the aforementioned fact.

2.5. Clients can access these Regulations at any time after clicking an appropriate link at the main page of website, download the document and print it.

2.6. Information about the Goods provided at the Store web pages, in particular description, prices, technical and operational parameters shall constitute an invitation to conclude an agreement within the meaning of art. 71 of the Civil Code.


III. Rules of using Online Store

3.1. You have to register in the Online Store prior to using it.

3.2. Registration is conducted by filling in and accepting the registration form available at one of the Website web pages.

3.3. You have to accept the Regulations content and provide personal data marked as necessary in order to complete registration.

3.4. Motive&More Sp. z o.o. has the right to deprive the Client of his right to use the Online Store, as well as to limit his access to a part or all of the resources of the Online Store, effective immediately, in the event of violation of the Regulations by the Client, and in particular if the Client:

a) provided incorrect, inaccurate or invalid data during the registration in Online Store which is misleading or violates third party rights,

b) violated personal rights of third parties, in particular the personal rights of other clients within the Online Store,

c) committed other actions which shall be deemed by Motive&More Sp. z o.o. to be non-compliant with applicable laws, general rules of using the Internet or harming the reputation of Motive&More Sp. z o.o. 

3.5. Client deprived of the right to use the online store cannot register again without the prior consent of Motive&More Sp. z o.o.

3.6. In order to ensure the secure transfer of messages and data related to the services provided within the Website, the Online Store shall undertake technical and organizational measures appropriate to the degree of security risk, in particular measures to prevent acquisition and modification by unauthorized parties of personal data in the Internet.

3.7. Client shall in particular:

a) not supply or transmit content prohibited by law, e.g. content which promotes violence, is defamatory or infringes upon personal and other rights of third parties,

b) use the Online Store in a manner which does not interfere with its functioning, in particular by using specific software or devices,

c) not undertake activities such as sending or posting unsolicited commercial information (spam) within the Online Store,

d) use the Online Store in a manner not cumbersome for other clients and for Motive&More Sp. z o.o.,

e) use any content of the Online Store only for his own personal use,

f) use the Online Store in compliance with applicable provisions of law within the territory of Republic of Poland, Regulations and general rules of using the Internet.

3.8. User’s Account and order forms shall be provided free of charge for an indefinite period of time. Client has the right to delete the account (resign) at any time and without stating the reason, by sending an appropriate request to Motive and More sp. z o.o., in particular by electronic mail to


IV. Procedure of concluding a Sales Agreement

4.1. In order to conclude a Sales Agreement via Online Store, please enter the website, choose the Online Store’s offer by undertaking technical actions on the basis of displayed messages and information available online.

4.2. Clients choose ordered Goods by adding them to their shopping cart.

4.3. During placing an Order - until clicking the “Order” button - Client still can modify entered data and chosen Goods. For that purpose, follow displayed messages and information available on the website.

4.4. After providing all necessary information to the Online Store, Client will be able to see the summary of a placed Order. Summary of a placed Order shall include the following information:

a) subject matter of the order,

b) unit and total price of ordered products or services, including delivery costs and additional costs (if any),

c) chosen payment method,

d) chosen delivery method,

e) delivery time,

4.5. Accepting Regulations content, providing personal data marked as necessary and clicking “Order and pay” shall be necessary to send the Order.

4.6. Sending Order by the Client shall constitute a declaration of will to conclude Sales Agreement with Motive&More Sp. z o.o. in accordance with the content of the Regulations. 

4.7. After placing the Order, Client shall receive an e-mail with the final confirmation of all relevant Order elements.

4.8. Agreement shall be concluded after receiving the aforementioned e-mail by the Client.

4.9. Sales Agreement shall be concluded in Polish in accordance with the Regulations.

4.10. Terms and conditions of payment with loyalty points for goods and receiving points shall be subject to the Motive & More Loyalty Programme Regulations.


V. Delivery

5.1. Goods Delivery shall be limited to the European Union area and Goods shall be delivered to address indicated by the Client during placing the Order.

5.2. Delivery of ordered Goods shall be by DHL courier mail and InPost company. There shall also be a possibility of a pickup in person. Delivery costs shall be indicated during placing an Order.

5.3. Delivery time shall be up to 3 working days from the date of placing the Order by the Client. Courier delivers the parcels in Poland not later than within two working days since Store’s postage. In case of delivery outside of Poland, delivery time by the DHL courier could vary from 3 to 7 working days.

5.4. Key provisions of the Sales Agreement for the Goods shall be preserved, secured, made available and confirmed to the Client by sending a printout of the confirmation, specification of the Order and VAT invoice to the Client's e-mail address and attaching it to the shipment containing the Goods.

VI. Prices and methods of payment

6.1. Goods prices shall be in Polish zlotys and contain all elements, including VAT (in particular rate amount), customs duty, etc.

6.2. Client can settle the payment by:

a) transfer to indicated bank account number,

b) DotPay, PayPal system, 

c) payment cards,

d) cash upon delivery.


VII. Right of withdrawal

7.1. According to Article 27 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 24 June 2014, item 827), a Client with the Consumer

status who has concluded a remote agreement may withdraw from it within 14 days without stating a reason and without incurring any costs. Motive&More Sp. z o.o. shall not be required to reimburse any supplementary costs if the Client has expressly opted for a delivery method other than the least expensive type of standard delivery of Goods offered by the Motive&More Sp. z o.o.

7.2 If Clients do not hold the Consumer status, rules and deadlines for withdrawal from the agreement shall be governed by the provisions of the Civil Code.

7.3 Principles referred to in item VII of the Regulations regarding withdrawal from the Agreement on the basis of Consumer Rights Act of 30 May 2014 (Polish Journal of Laws of 24 June 2014, item 827) shall not apply to the agreements whereby the Consumer shall be obliged to pay an amount which does not exceed fifty zlotys.

7.4 Period for withdrawal from the Agreement shall commence from the date on which the product is received by the Client or a third party indicated by the Client other than the carrier.

7.5 In order to exercise the right of withdrawal from the Agreement, Client shall notify Motive&More Sp. z o.o. about the decision to withdraw from the agreement through an explicit statement on withdrawal from the agreement. Client may use sample of the form of withdrawal from the agreement indicated by Motive&More Sp. z o.o. However, using the sample form is not mandatory.

7.6 Motive&More Sp. z o.o. shall reimburse payment amount using the same payment method as chosen by the Client. If the Client paid for the product by cash upon delivery, he shall consent to the return of funds in case of withdrawal to the bank account specified in the withdrawal declaration. Store can reimburse financial funds only after receiving returned Goods in unused and unchanged condition.

7.7 Consumer shall not have the right to withdrawal from the Agreement regarding the following agreements, appropriately according to art. 38 of Consumer Rights Act of 30 May 2014 (Polish Journal of Laws of 24 June 2014, item 827);

a) service contracts after the service has been fully performed upon obtaining consumer’s prior explicit consent and with the acknowledgement that consumer will lose his right of withdrawal once the contract has been fully performed by the Motive&More Sp. z o.o.;

b) where clearly personalized Product is delivered, produced according to consumer specifications or intended to meet individual needs of the consumer;

VIII. Complaints regarding Goods

8.1. As a seller, Motive&More Sp. z o.o. shall be liable to the Client who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Article 556[1] - 556[3] of the Civil Code.

8.2. Complaints arising out of violation of the Client’s rights guaranteed by law or on the basis of these Regulations shall be sent to Motive&More Sp. z o.o. shall handle each complaint within 14 days, and if it is not possible, it shall notify the Client after the complaint has been handled.


IX. Complaints on providing services by electronic means

9.1. Motive&More Sp. z o.o. undertakes actions to ensure proper performance of the Store according to the latest technical knowledge and it shall remove any faults reported by the Clients within reasonable period of time.

9.2. Client shall promptly notify Motive&More Sp. z o.o. about any errors or interruptions in the Online Store.

9.3. Client can report any Store malfunction in writing to the address: Św. Gertrudy 18/2 31-046 Kraków, using our e-mail address: or using our contact form.

9.4. The complaint shall include Client’s full name, correspondence address, type and date of Store malfunction occurrence.

9.5. Motive&More Sp. z o.o. shall handle each complaint within 14 days, and if it is not possible, it shall notify the Client after the complaint has been handled.

XI. Final provisions

11.1. Settlement of any possible disputes between Motive&More Sp. z o.o. and the Client who is a consumer within the meaning of Art. 22 [1] of the Civil Code shall be subject to competent courts according to appropriate Civil Procedure Code provisions.

11.2. Motive&More Sp. z o.o. hereby informs that Client with a Consumer status have the possibility to exercise out-of-court complaint and redress options, including mediation. Lists of permanent mediators and mediation centers are forwarded and available at Presidents’ of District Courts. Detailed information about exercising those options are made available to the public at the offices of and on the websites of municipal/county consumer ombudsmen, social organizations whose statutory areas of responsibilities include customer protection and Regional Trade Inspectors.

11.3. Clients with the Consumer status can exercise the out-of-court possibility of settling disputes by electronic means through the European Union's ODR internet platform which enables lodging complaints and pursuing claims concerning the concluded agreement on the website: E-mail address of the Store:

11.4. Settlement of any possible disputes between Motive&More Sp. z o.o. and the Client who is not a consumer within the meaning of Art. 22 [1] of the Civil Code shall be subject to the competent court having jurisdiction over the registered seat of Motive&More Sp. z o.o.

11.5. In matters not regulated herein, provisions of Civil Code shall apply as well as provisions of the Act on Providing Services by Electronic Means, other applicable provisions of Polish law and European Union law, in particular GDPR (General Data Protection Regulation) - Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

11.6. These Regulations shall become effective on 25 May 2018.
